§1. General provisions

  1. These terms set out the rules for using the website rafalrudko.com (the Website) and the services it provides electronically. They are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  2. The services are provided by Rafał Rudko, running a business as Rafał Rudko Ciekawe Miejsce Związane Ze Sztuką, ul. 3. These terms are available free of charge on the Website in a form that allows them to be downloaded, saved and printed.
  4. Sales (for example of online courses, prints or merchandise) will be covered by separate terms of sale, published before sales begin.

§2. Services

The Provider offers the following services free of charge:

  1. access to the Website's content: painting galleries, articles, information about exhibitions and workshops — without an account;
  2. a user account — access to the parts of the Website for signed-in users and to the account settings;
  3. a newsletter — news about new courses, workshops and exhibitions sent by email, only to people who have consented to it.

§3. Technical requirements

  1. Using the Website requires a device with internet access and an up-to-date web browser with JavaScript enabled.
  2. Creating an account and receiving the newsletter require an active email address; signing in requires a browser that accepts the necessary cookies (described in the cookie policy).
  3. Using the internet carries risks such as malware, password theft or messages impersonating the Provider (phishing). The Provider never asks for your password by email. It is wise to use a password not used on other websites.

§4. Account

  1. An account is created with the registration form (email address, password, optionally first name) or by signing in with a Google account. Registration requires accepting these terms.
  2. An account created with the form becomes active once you click the activation link sent to the email address given.
  3. The contract for keeping the account is concluded when the account is activated, for an indefinite period.
  4. You may terminate the contract at any time by deleting the account in its settings or by writing to the Provider. Deletion takes effect immediately.
  5. You keep your password confidential and do not share your account with others.
  6. The Provider may suspend an account or terminate the contract with 14 days' notice, or with immediate effect in the event of a serious breach of these terms or the law. The reason is given by email.

§5. Rules of use

  1. You may not provide unlawful content or disrupt the Website, including by automated large-scale downloading of content or attempts to get around its security.
  2. The paintings, photographs and texts published on the Website are works of Rafał Rudko protected by copyright. Copying and distributing them beyond permitted use requires the author's consent.

§6. Newsletter

  1. Subscribing to the newsletter is voluntary and is done by ticking the consent box when registering or in the account settings.
  2. Consent can be withdrawn at any time in the account settings or with the link in a message, without giving a reason.

§7. Complaints

  1. Complaints about the services can be sent by email to rafalrudko.cmzzs@gmail.com.
  2. A complaint should include the sender's email address and a description of the problem.
  3. The Provider replies within 14 days of receiving the complaint, to the email address it was sent from.

§8. Personal data

How personal data is processed and cookies are used is described in the privacy policy and the cookie policy.

§9. Changes to these terms

  1. The Provider may change these terms for important reasons, in particular changes in the law, changes to the services or security considerations.
  2. Account holders are informed of a change by email at least 14 days before it takes effect. Anyone who does not accept the changes may delete their account before that date.
  3. Earlier versions of these terms are archived, and the date of the current version is shown at the top of the page.

§10. Final provisions

  1. Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.
  2. These terms do not limit consumers' rights under mandatory provisions of law.
  3. Consumers may use out-of-court dispute resolution, for example the help of a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów).
